Our principal place of business and practice address is Garden Vets at Keele Keele University Science and Innovation Park Keele Staffordshire United Kingdom ST5 5NS.

0.3 Writing includes emails. When we use the words writing or written in these Terms this includes emails.
1.1 These Terms and Conditions govern the provision of veterinary services by Garden Vets under a Pay-As-You-Go model.
1.2 By requesting booking or receiving services from Garden Vets on a PAYG basis you agree to be bound by these Terms.
1.3 These Terms apply only to PAYG Services. Subscription services including PetCare Plans such as PCP and PCA are governed by separate contractual terms.
2.1 Garden Vets operates two distinct service models
(a) PAYG Services which are ad hoc and episodic veterinary services provided per consultation procedure or treatment
(b) Subscription Services which are continuous managed healthcare programmes delivered under a separate contract
2.2 PAYG Services are transactional and episodic in nature and do not constitute a managed healthcare plan.
2.3 PAYG Services do not include preventative care scheduling or ongoing care management.
2.4 PAYG Services do not create any obligation for continuity of care beyond the specific service provided.
2.5 Each interaction under PAYG constitutes a separate and independent contract.
3.1 PAYG Services are intended for
(a) non registered or occasional clients
(b) clients referred from other veterinary practices
(c) one off consultations diagnostics treatments or procedures
3.2 PAYG Services are not designed to replace ongoing primary veterinary care.
3.3 Responsibility for ongoing or routine veterinary care remains with you and where applicable your primary veterinary practice.
5.1 A contract between you and Garden Vets is formed each time you request or book an appointment present your animal for treatment or authorise a procedure or service.
5.2 Each contract applies only to the specific services agreed at that time.
6.1 All PAYG Services are charged in accordance with the Garden Vets price list which is available on request or as displayed.
6.2 Fees reflect the episodic nature of PAYG services the absence of prepayment or risk sharing and immediate service delivery.
6.3 Payment is due at the time of consultation upon completion of treatment or in advance where requested.
6.4 Garden Vets may require prepayment or deposits and may refuse or delay services where payment is not made.
6.5 Where third party finance insurance or payment providers are used you remain responsible for any unpaid balance.
7.1 Estimates may be provided where appropriate but are indicative only.
7.2 Veterinary treatment may vary based on clinical findings.
7.3 You agree to authorise appropriate diagnostics and treatment and accept that costs may change where clinically necessary.
8.1 Appointments may require a deposit or prepayment.
8.2 You may cancel or rearrange an appointment without charge if at least 24 hours notice is provided.
8.3 Garden Vets may charge a cancellation fee or the full consultation fee where insufficient notice is given or where an appointment is not attended.
8.4 Repeated missed appointments or misuse of services may result in refusal of future bookings or a requirement for prepayment for all future services.
9.1 PAYG Services are provided subject to availability.
9.2 Garden Vets operates a mixed service model and manages capacity accordingly.
9.3 Access to appointments under PAYG is not guaranteed and may vary based on demand clinical urgency and operational requirements.
9.4 Garden Vets does not guarantee continuity of clinician ongoing availability or priority scheduling under PAYG.
10.1 Where services are provided following referral from another veterinary practice Garden Vets acts as a consulting or treating provider only.
10.2 Responsibility for ongoing care remains with the referring practice unless otherwise agreed.
10.3 Garden Vets may communicate with referring practices where clinically appropriate.
11.1 Garden Vets will provide services with reasonable care and skill in accordance with professional standards.
11.2 Under PAYG care is limited to the services requested and agreed.
11.3 No ongoing monitoring or follow up is provided unless explicitly arranged.
11.4 You are responsible for monitoring your animal following treatment and for seeking further veterinary care where required.
12.1 Medicines are prescribed in accordance with veterinary regulations.
12.2 Prescriptions may be provided upon request subject to appropriate clinical assessment and applicable fees.
13.1 Where you hold pet insurance you remain responsible for all fees.
13.2 Reimbursement is a matter between you and your insurer.
13.3 Garden Vets may assist with claim documentation but is not responsible for claim outcomes.
14.1 Nothing in these Terms limits liability where it is unlawful to do so.
14.2 Garden Vets is not liable for indirect or consequential loss or for outcomes arising from incomplete medical history or non disclosure.
15.1 Personal data will be processed in accordance with applicable data protection laws.
15.2 Clinical records remain the property of Garden Vets.
16.1 Garden Vets operates as an accredited clinical teaching practice in partnership with Harper and Keele Veterinary School. Clinical teaching forms an integrated and continuous component of the services provided.
16.2 As part of this model veterinary students including but not limited to final year students and other professional learners may participate in consultations case discussions examinations diagnostic procedures treatment planning surgical procedures and other aspects of patient care.
16.3 Students attending Garden Vets are typically in the later stages of their professional training and are trained knowledgeable and competent in clinical skills appropriate to their level of study. Students are not registered veterinary surgeons and are not permitted to take sole clinical responsibility for any case.
16.4 All student participation shall occur under the direct supervision of a qualified experienced and registered veterinary surgeon. A registered veterinary surgeon shall at all times retain overall responsibility for clinical decision making diagnosis treatment planning and patient care. No student shall provide unsupervised clinical care or independent clinical decision making.
16.5 The involvement of students or other learners does not diminish vary or replace the professional standard of care owed to you or your pet. The same clinical standards apply regardless of whether teaching activity is occurring.
16.6 By requesting or receiving PAYG Services and presenting your pet for treatment you acknowledge and consent to
(a) the status of Garden Vets as a clinical teaching practice
(b) the participation of veterinary students and other professional learners in aspects of your pet’s care
(c) such participation occurring under appropriate supervision and in accordance with professional standards
16.7 You acknowledge that supervised student involvement forms part of the ordinary delivery of services at Garden Vets and does not of itself constitute a breach of duty negligence or reduction in the standard of care.
16.8 If you have specific concerns regarding student participation you must raise them in advance of consultation. Garden Vets will consider such concerns reasonably but reserves the right to determine how services are delivered in accordance with professional obligations and teaching commitments.
16.9 Nothing in this clause limits the obligation of Garden Vets to act at all times in the best clinical interests of your pet or in accordance with applicable professional and regulatory standards.
17.1 Garden Vets operates multiple service models including PAYG Services and Subscription Services which are governed by separate contractual terms.
17.2 Where a client purchases or receives both PAYG Services and Subscription Services
(a) the Subscription Terms shall take precedence in relation to Subscription Services
(b) these PAYG Terms shall apply solely to PAYG Services and any additional services provided outside the scope of Subscription
17.3 These PAYG Terms shall not amend vary or supersede the Subscription Terms except where expressly agreed in writing.
17.4 In the event of any direct conflict between the Subscription Terms and these PAYG Terms in relation to Subscription Services the Subscription Terms shall prevail.
17.5 In the event of any direct conflict in relation to PAYG Services or services provided outside Subscription the PAYG Terms shall prevail.
18.1 Garden Vets may update these Terms from time to time.
18.2 Updated Terms will be published on the website and will apply to future services.
19.1 These Terms are governed by the laws of England and Wales.
